Overwatch Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Overwatch application (the "Service") operated by David Seguin Consulting Inc. ("us", "we", or "our").

1. Introduction

This Service is a demo application designed to showcase features and functionalities of a plugin launcher

 

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Use of Our Service

Restrictions:

You agree not to:
  - Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
  - Attempt to gain unauthorized access to the Service or any related systems or networks.
  - Interfere with or disrupt the Service or servers or networks connected to the Service.
  - Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission by us.

 

3. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of David Seguin Consulting Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of both the Canada and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of David Seguin Consulting Inc.

 

4. User Accounts

Account Creation:

You may need to create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account.

 

Account Termination:

We reserve the right to terminate or suspend your account at any time without notice if we believe that you have violated these Terms.

5. Limitation of Liability

No Warranties:

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, and hereby disclaim all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement.

Liability Limitation:

To the maximum extent permitted by applicable law, in no event shall David Seguin Consulting Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
